Ontario Changes Social Assistance Rules: Eligibility Update for Ontario Works and ODSP

The Ontario government has officially updated regulations regarding eligibility for provincial social assistance programs. Under newly enacted amendments to the Ontario Works Act, 1997 and the Ontario Disability Support Program Act, 1997, individuals residing in Canada without legal immigration status, as well as temporary residents (such as visitors, international students, and temporary foreign workers), are strictly ineligible to receive financial benefits through Ontario Works (OW) or the Ontario Disability Support Program (ODSP).

This decision, announced by the Ontario Newsroom, follows provincial discussions regarding public expenditure, program integrity, and legal immigration requirements.

  • Ineligibility for Undocumented Residents: Individuals residing in Canada without legal immigration authorization cannot apply for or receive OW or ODSP payments.
  • Exclusion of Temporary Status Holders: Individuals authorized to remain in Canada on a temporary status—including holders of study permits, temporary work permits, and visitor/tourist visas—are excluded from social assistance eligibility.
  • Mandatory Verification: All applicants must provide verified proof of Canadian citizenship, permanent residency, or protected refugee status to qualify for benefits.
