Launch of the New EI Board of Appeal 2026: A Complete Guide to EI Reforms

Effective April 1, 2026, the Government of Canada is officially launching the Employment Insurance (EI) Board of Appeal. This landmark reform marks a shift back to a regional, community-focused decision-making process for EI disputes, replacing the previous Social Security Tribunal (SST) General Division for first-level appeals.

What is the EI Board of Appeal?

The EI Board of Appeal is a new quasi-judicial body designed to hear and decide on first-level EI appeals (excluding constitutional challenges). The goal of this reform is to make the recourse process more transparent, timely, and reflective of local economic realities across Canada.

The Tripartite Decision-Making Model

One of the most significant changes is the return to a tripartite panel. Every appeal will be heard by a three-person panel consisting of:

  • A Presiding Member: Appointed by the Governor in Council.
  • An Employer Representative: Appointed to represent the interests and perspectives of the business community.
  • A Worker Representative: Appointed to represent the interests and perspectives of the labour community.

Structure and Leadership

The Board is led by an Executive Head and four Regional Coordinators. While administrative duties are handled by these full-time officials, the actual legal and factual determinations of your case are made solely by the part-time tripartite panels to ensure impartiality.

Transition Period: What Happens to Current Appeals?

To ensure a seamless transition, the government has outlined a parallel operational phase:

  • Before March 31, 2026: The Social Security Tribunal (SST) will continue to hear and decide appeals received.
  • April 1, 2026, and onwards: All new first-level appeals will be managed by the EI Board of Appeal.
